The supervisory jurisdiction of the provincial councils in the Kurdistan Region (An analytical study in light of the Kurdistan Region Governorates Law No. 3 of 2009)

Abstract

The provincial councils in Kurdistan region iraq has ended its first electoral term

under the applicable new provincial law No. 3 of 2009 which is the

first regional law issued by the Parliament of Kurdistan to consolidate and

organize the administrative decentralization process on its regional image

after the passage of nearly two and a half decade of the formation of the

Kurdistan Parliament considering the region as a current political entity

exercising its political and legal powers in the geographical area prescribed

by the people of Kurdistan.

 This late law came in the view of its many legal and popular requirements toembody the regional decentralization in the provinces of the region through the election of a local body by the people of the provinces which has the characteristics and the various legislative, administrative and financial jurisdictions on the top of it is considered a supervisory board of traditional institutions that operate in the administrative boundaries of the province.

 This has made these councils to be the supervisory jurisdiction. In this

stage , it is of paramount importance in our view especially if we link the

theoretical study with the applied one in order to reach the weak points and

shortcomings in the texts of the law and in its application on the ground, and then the comparison between the theoretical and applied parts.

 To to know the regulatory role of the provincial councils in the region, we

have divided the study into two parts. The first one is devoted to study the

legal organization of provincial councils in the region and the second one is

devoted to the supervisory role of these councils. We concluded the research with the results of our findings and at the end we presented some

recommendations and suggestions.
